Welcome to GarageZale. These Terms of Service (“Terms”) govern your access to and use of the GarageZale platform, including our websites, mobile applications, subdomains, and any associated services, features, or technologies (collectively, the “Platform”), operated by GarageZale LLC (“GarageZale,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use or access the Platform.

1. Eligibility and Account Access
You must be at least 18 years old (or the age of legal majority in your jurisdiction) and capable of entering into a binding legal agreement to access or use the Platform. By creating an account, you represent and warrant that you meet these eligibility requirements.

You are solely responsible for safeguarding your account credentials and maintaining accurate account information. You agree that GarageZale is not liable for any unauthorized use of your account arising from lost, shared, or compromised login information.

2. Acceptable Use
You agree to use the Platform in compliance with all applicable laws and regulations. You further agree not to:

• Post false, misleading, infringing, or defamatory content
• Engage in fraudulent, abusive, harassing, or discriminatory behavior
• Violate local, state, or federal commerce or safety regulations
• Use automated scripts or bots without express written authorization
• Attempt to interfere with or compromise the integrity or security of the Platform
  GarageZale reserves the right to suspend or terminate access, remove content, or take other appropriate actions in response to violations or suspected misuse.

3. Listings and Marketplace Conduct
GarageZale allows users to post and manage listings for garage sales, personal goods, events, and related services. All listings must:

• Provide accurate, truthful descriptions and images
• Comply with local laws and municipal codes
• Exclude prohibited, illegal, or unsafe goods

Prohibited items include, but are not limited to:

• Firearms, explosives, or ammunition
• Counterfeit or stolen merchandise
• Controlled substances
• Recalled or hazardous items
• Adult content or services not permitted under applicable laws

We reserve the right to remove or restrict listings at our sole discretion and without notice.

4. Payments, Premium Services, and Refunds
GarageZale may offer optional paid features, premium placement, or promotional tools. By purchasing any paid service, you agree to:

• Pay all applicable charges using a valid payment method
• Authorize recurring charges, where applicable
• Understand that all payments are final and non-refundable unless expressly stated otherwise

Pricing and service offerings are subject to change. Payment processing may be handled by third-party providers and governed by their terms and policies.

5. Intellectual Property
All content, trademarks, and technology associated with the Platform are the exclusive property of GarageZale LLC or its licensors. You retain ownership of content you upload, but by doing so, you grant GarageZale a non-exclusive, worldwide, royalty-free, perpetual license to:

• Use, reproduce, distribute, display, and promote your content on the Platform
• Leverage your content for operational, marketing, and analytical purposes
• Retain your content as required for legal, audit, or dispute resolution purposes

This license survives the termination of your account or removal of content, to the extent required by law.

6. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices, including any applicable rights under laws such as the California Consumer Privacy Act (CCPA).

GarageZale does not sell personal information and only shares data as needed to operate the Platform or comply with legal obligations.

7. Third-Party Integrations
The Platform may include integrations or services provided by third parties, such as payment processors, mapping providers, or communication tools. GarageZale is not responsible for the content, accuracy, or functionality of these third-party services, and your use of them may be subject to their respective terms and policies.

8. Dispute Resolution and Arbitration
Any disputes or claims arising from these Terms or your use of the Platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration may be conducted virtually or in a mutually agreed-upon location within the United States.

Class action and jury trial waivers: You agree to waive any right to participate in class action lawsuits or jury trials against GarageZale LLC.

9. Disclaimers and Limitation of Liability
The Platform is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. GarageZale disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, GarageZale shall not be liable for any indirect, incidental, punitive, or consequential damage arising out of or relating to your use of the Platform.

Our total liability to you for any claims under these Terms will not exceed the greater of:
(a) One hundred U.S. dollars (USD $100) or
(b) The amount you paid to GarageZale in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless GarageZale LLC, its officers, affiliates, and employees from any claims, damages, or expenses arising out of your use of the Platform or violation of these Terms.

10. Termination and Account Closure
We reserve the right to suspend, restrict, or permanently disable access to your account at our sole discretion, including for violations of these Terms, suspected fraud, or misuse.

You may delete your account at any time through your account settings. Some information may be retained for compliance, auditing, or legal purposes, as permitted or required by law.

11. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the United States and the state in which your claim arises. You agree to submit to the jurisdiction of such courts, unless otherwise resolved through arbitration as outlined above.

12. Modifications to These Terms
GarageZale reserves the right to update or revise these Terms at any time. Material changes will be communicated via the Platform or by other appropriate means. Your continued use of the Platform following the effective date of updated Terms constitutes your acceptance of those changes.
